There is a corollary of this. If a datasheet was legislated for, we would not do one, we would just pull the DA909x from any sort of sale because the overhead of developing a datasheet would outweigh any income from the sales of the chips for repair purposes.
I would expect legislation to mandate the production of a datasheet for any proprietary components used. So it's either use something which already has a datasheet or use something else and produce that datasheet.

"We'll use it but not produce a datasheet and not sell the chip" would not be compliant with the legislation I envision.

Manufacturers might not like that, especially profit-driven businesses, but I bet there are a lot of things they don't like doing which they are forced to do through legislation. They'll just have to suck it up as another cost of doing business. Currently it's the consumer who has to suck it up and IMO there's a more equitable balance which can be had.
I think you are missing the main focus here, which is making a given product more repairable
In my opinion, making available as many of the proprietary parts, schematics/boardviews as possible would make much more sense, than the datasheet of a component.
Every company has its own developments, some of which are better to be kept a secret from a business standpoint (so for example some guy in China can't completely copy the design).
So there should be some balance.
For example, there is no way they are going to sell the SoC on its own, as this would kill their business, but I don't really see a reason why not to make the DA9091 chip available.

Also, I don't really see how having a complete datasheet would benefit the diagnosis/repair process in any significant way.
I mean there is just no way in hell you are going to repair the chip itself.
And if the company wants to use a given proprietary component only for its devices, let it be that way.
Most of the time it is nothing groundbreaking or unheard of so if you want to do something similar on your own there are lots of alternative options.

After all, it's a great feeling when you know your rights, you stand up for them and something changes as a result, but we all need to know our limits.
